The judge in OANP’s lawsuit recently dismissed the third claim that OANP had brought forward against Health Net and ASH. While we are disappointed this third claim (representing the doctors injured by discrimination) won’t be considered, we were already aware that it was the most difficult to pursue and we remain optimistic that the judge will see how discriminatory actions against NDs also injured patients, as addressed in the first two claims which will continue to move forward. Here is a concise description of the original claims.
1. A class action claim to reimburse individuals who have been denied benefits under their Health Net insurance plans as a result of discriminatory practices against NDs
2. A class action claim to require repayment of profits retained by Health Net and ASH as a result of their discriminatory practices against NDs
3. A request for a declaration of the court that the contracts between Health Net and ASH unlawfully discriminated against NDs.
